mistake. an officer killed by his long-time colleague. we're learning more about sergeant tom smith and getting a clear picture of michael mays, the officer that shot him. we behind with jodi hernandez and the internal investigation, jodi? >> reporter: raj, it is very complex investigation. tonight, we know what led officers to that dublin apartment, but we still do not know what happened inside that prompted a bart officer to pull the trigger. >> we are in shock, disbelief, we're numb. we're grieving, and please give us some time. >> reporter: a visibly shaken chief ken ton rainy this morning identified the bart detective accidently shot and killed by a fellow officer as 42-year-old tom smith, the head of the department's detective unit. >> both professionally and personally, he will be sorely

missed. >> reporter: rainy says smith and six other bart officers with the sheriffs deputy went to the dublin apartment on a probation search to recover a laptop andthandth other property that 20-year-old john henry lee stole during a bart station robbery last week. police arrested lee last thursday after chasing the suspect who they say was driving a car that had been reported stolen from another bart station. >> if they knew that john henry lee was in custody, and that's always a possibility that somebody else can be in the apartment. >> reporter: alameda deputy says the apartment door was unlocked, which could raise tensions. >> if the door is unlocked, it usually means somebody is there, so they probably thought someone was in the apartment. >> reporter: what led the

officer identified as michael mays to fire his gun, the chief is defending the approach to the search. the independent police auditor is determined to ensure a thorough investigation despite all the emotions. >> the tragedy is really what this is. it's a really difficult thing for this department to deal with, for bart to deal with because of the heightened emotions there and the sadness over the loss of a member of the bart family. >> reporter: now bart's independent police officer says we went out to the scene in dublin and observed the interviews of the officers who were present when the tragedy happened. he said was that a process that went well into last evening. he said they are gaining an understanding of what took place but so far investigators are not sharing the details. reporting live, i'm jodi hernandez. sergeant smith was a 23-year veteran of the bart police force and we're told he took his

responsibilities at work and home very seriously. cheryl hurd continues coverage from san ramon, cheryl? >> reporter: janelle, the former bart chief says he promoted tom smith to sergeant status. he said smith always wanted to be a police officer and that he loved his job. >> i hate to put it in a academic basis, but you study what happens, you learn from mistakes, and you move on. the deputy has to recover from this and must. >> reporter: but former bart police chief gary g. knows recovering from this tragedy won't be easy. you have two men who have worked side by side for years as detectives for bart, and one of them makes a horrible mistake. >> if you looked tom and mike together as detectives, you would think they are a similar personali

personality. >> reporter: they were similars in many ways. michael was hired in february 2000. they both loved police work, but g. says smith had another passion, his young daughter and his wife kelly, who is also a bart police officer. >> different personality, kelly is much more out going than tom, but both had the same level of enthusiasm for the job. >> reporter: a job that is very dangerous. according to the latest fbi statistics, 45 law enforcement officers were accidently killed in the line of duty in 2012. 22 died in automobile accidents, two died in accidental shoot ls. san francisco state professor woods teaches criminal justice. >> this is a tragic situation. it's never happened in the history of bart, and therefore, i don't think that it shows that there is a flaw in the training as much as it shows that we need to adjust our training in a

specific way. >> reporter: former bart police chief g. says it's more complicated than that. >> all the training that you have cannot replace or replicate what happens in real life situations, and we saw the t tragedy of that yesterday. >> reporter: sergeant smith comes from a family of police officers. he has a brother whose a sheriff's deputy and another brother who works for the newark police department. >> and stay with us for continuing coverage of the story, both on air and online, nbcbayarea.com is updated around the clock. injured on the job and getting hurt financially. a growing number of san jose police officers have to deal with collection agencies for unpaid medical bills. these officers say the hospital visits are for work-related injuries. nbc damian trujillo joins us from city hall. who are the officers blaming?

>> the city behind me, but the city isn't sure that's the case. in september, we heard about one case, that number is now up to six. here with most of those bills for the workers -- not from the workers compensation but collections agency to the officers. those officers are getting angry because they are a beaten down police force they say. they put on the uniform knowing they might have to fight a bad guy that day. it happened to officer rob dillon and sergeant rule martin martinez. >> he came up from behind and attacked me. during the fight he tried to take my gun. >> reporter: both men were injured in the fight. dillon shattered four of his teeth and tore ligaments on one knee. martinez also suffered knee and shin injuries. >> we kind of put ourselves out there for the citizens of san jose. >> reporter: but then the bills arrived and after the bills, letters from collection agencies warning the officers to pay

debts. >> i went for a refinance, and mortgage lender that was working with indicated i was denied because a collection agency had affected my credit. >> i received phone calls saying if i didn't pay the bill, it would affect my credit. >> reporter: they made several trips to h.r. but the letters kept coming. >> when you're dealing with a department whose moral is as low as san jose at the moment, this is another kick in the gut. >> reporter: so the police union filed a grievance against the city last week. >> they are supposed to pay the medical bills. they always have. we got lots of fights from the city now. this is one fight we didn't think we had. >> the most important thing, the employee shouldn't get a bill. >> reporter: but david says the problem doesn't appear to be in his h.r. department. >> from my understanding, this is an issue from the provider and communication from the provider. our staff is pretty much on top of this. we have a good worker's comp

administration. >> reporter: the bill was finally resolved after a year. sergeant martinez is still waiting after 11 months and still has his poor credit score to worry about. today one of those providers told me in california, doctors are not employed by the hospitals, so workers comp employees have to take up their claims with those individual doctors. we're live in san jose city hall, i'm damian trujillo. >> thanks. ignored and disregarded, some engineers say they were shut down after raising questions about the structural safety of the bay bridge. that's one of the claims in a report commissioned by a state senate committee. the report was released today ahead of an investigation hearing set for friday. investigators raised concerns about the lack of transparency and the transportation commission both overseeing the largest public works project in state history. the report looked how they dealt

with the faulty bolts discovered last march. repairs have since been made. the new span nearly ten years late and over budget. oakland police released a photo of a toyota suv linked to a deadly shooting. the newer model silver suv seen here as paper license plates, when two chp officers pulled over the car last night, they say the driver drove off and the passenger tried to run. officers chased down that passenger who they say was armed. they also released a k-9. the officers fired guns and that passenger was killed. the dog was wounded. that dog under went surgery and is expected to be back at work next month. this was the second deadly shooting by chp officers in oakland in the last 24 hours. a suspected child pornographer is now off the grid. police arrested christopher shuette at his home on monday.

cyber tips about suspicious internet activity got the investigation going. they pinpointed it to his house and found usb drives with thousands of incriminating photos and he uploaded files to the internet. not quite neighborly love. a family was reviewing surveillance video when something caught their eye. that family saw their neighbor on the video, walked by their house wearing clothing and slippers stolen from their house two weeks before. police say when they searched the home, they recovered nearly all of the stolen items. she was booked at the santa rita jail. still ahead at 6:00, the raiders playing defense against the cheerleaders. the governor, he's in good spirits but is all the excitement clouded some facts when it comes to the state's health? our reality check is next, plus. >> i'm kris sanchez where the

we have some developing news in east bay. the commute in the try valley is a mess. a live shot now from the hd traffic cam. two lanes of eastbound 580 are closed after approximately 200 gallons of oil spilled from a big rig. once again, this is 580 near livermore. the red lights, that is going east and it's jam packed. this is near flynn road but the backup goes to the 680

facts. >> reporter: a research fellow and consultants for multiple republican governors who is as informed as anybody. if you asked walin about california's underfunded pension system, which as brown mentioned in wednesday's speech looms large but how large? >> our long-term liabilities are enormous, ever growing. let me list some of them, over and well over 100 billion owed to the state, workers teachers and judges. >> but you're only hearing part of the story. >> that's a brick in the wall. we're talking about the larger obligations, not just teachers and bond payments. it's the number of judges anywhere from 200 to 300 and 400 million depending who you talk to. >> while estimates vary, this study for economic policy research pegs the total pension research around 500 billion, nowhere close to what the governor told californians. >> in the governor's defense he was candidate about the bread

this was her promotional video from the website. the lawsuit claims they under pay and makes the cheerleaders pay for their business expenses. according to lacey's lawyer, cheerleaders are paid about $1200 a year and with practices, rehearsals and games that's less than $5 an hour. the lawsuit claims that former raider ets are owed thousands of dollars in back pay. the clock is now ticking. we will less than 40 hours away from the start of the mavericks invitational surf competition. it's considered the super bowl of the sport, and there is a flurry of activity behind the scenes. kris sanchez is live and fans are already making their way to the coast. >> reporter: yes, they sure are, and janelle, you know, super bowl of big wave surfing like the super bowl of football that's upcoming, takes a lot of planning and this year, of course, like years past, organizers of the 17 different agencies that have a hand in

go to nbcbayarea.com and we'll link you there. all right. so at sfo if you see a bunch of guys walking in with surf boards, you know where they are going. >> half moon bay. jeff ranieri with the micro climate forecast. >> the interesting thing about what is happening with this and the big waves is the storm system producing the waves is 1500 miles out. you can see it here, the area and the moisture. we're not going to see any rainfall with it but it will stir up the waves enough and already is now from 10 to 11.5 feet that it looks like, again, a go for friday's competition. we're seeing the waves increase at the immediate coastline. buoy reading eight to nine feet and a water temperature of 55. it's going to be held two miles off pillar point harbor. more on the forecast for those of you heading out in just a minute. i want to take care of something else at hand, the record heat again today. this now makes, if i remember

correctly, ten days of record-setting temperatures across the bay area. this is what we should have in april or early may. 77 in mountain view, san jose 72, napa also at 68. so look right now inside the sky camera network, temperatures cooling off. with clear skies, we'll see frost in the morning hours throughout the north bay and also have that increased fire threat. now as we get a look at tomorrow's temperatures, you'll notice it will be above average but not quite as warm as it was today. the south bay at 70, east bay averaging 71 and north bay 72. because we'll get an on shore flow at the coastline gradually and will cool temperatures. if you're heading through mavericks, princeton harbor to look at this on the big screen tvs because you can't go at the immediate coastline, fog in the morning and 49 and low to mid 60s truth the competition. you'll need a light jacket despite the awesome sunny and warm weather we had today. >> looks beautiful, thank you. coming up, a new warning about a particular class of cars

a woman is in jail tonight in connection with the homicide at a mobile home park. witnesses say they heard gunshots and then saw a woman running away naked. officers found a man who had been shot inside of a home at the mobile estates. this happened early this morning. police called a swat team to the scene and surrounded the mobile home park until that woman was arrested. the man later died at a nearby hospital. a soldier from salinas

saving water during this drought is easier than you might think when experts are making house calls and giving out free tools. the governor asked everyone to conserve 20% of their water use, but what is 20% is key? there is someone to help. marian favro is live with details for us, marianne? >> reporter: consider it a house call for your water woes, a water expert will come to your home and personally give you free advice on how you can reduce your water use by 20%,

make up a lot of ground fast. he's hardly household word and while brown is, that's for sure, he meanwhile has to define himself in a way that separates him from brown without losing moderate supporters. if he survives, top two primary system, then the beltitting is there is plenty to talk about. >> very nice. thank you for your insight. more news now, president obama announce add new task force assigned to stop sexual violence at college campuses. the president said he was speaking out as a father of two daughters and added that young men and women must speak out against the crimes and realize that sexual assaults are unacceptable. the new task force is expected to help schools prevent and respond to these attacks. this followed a new report from a white house counsel on women and girls.

according to that report, one in five women are sexual assaulted while in college and only 12% of victims report the attack. thousands of prolife demonstrators braved the bitter cold to mark the anniversary of the court decision legalizing abortion. marchers endured temperatures hovering around ten degrees today waving signs and chanting, you see the numbers of people that showed up. this is the 41s year of the march. another winter blast is causing headaches for people across the nation right now, including travelers trying to get in and out of sfo. 26 flights were cancelled there today. 1800 flights grounded nationwide. the winter storm stretches 1,000 miles and dumped record amounts of snow from the midwest to the east coast. for anyone whoever broke the glass on their iphone, take a look at this.

the distantive glass cube at the entrance to apple's flag ship store was shattered when a snowblower knocked into it. the estimated cost to repair the 32 foot glass panel is $450,000. well, small cars, big safety concerns, highway safety group released a report today that comes down hard on the so-called mini cars you see on the local freeways. in fact, the group is steering people away from driving the cars until they are made safer. we're talking about cars like the honda fit and fiat 500 which were rated poorest in a front crash safety test. the chevroletly spark is the one of 11 that got an acceptable rating. researchers say the occupant compartments were way too vulnerable during the test crashes. still ahead, is it really the end of facebook? facebook is being compared to and why it could signify

a foster farms plant reopened today after being closed for more than a week. the usda shut down the plant in livingston because of a cockroach infestation. foster farms cleaned and treated the plant within two days but later voluntarily shut down the plant again to implement more safety measures.
